If you buy a mare in foal and she gives birth when you own her are you the breeder of that foal or is the farm you purchased the mare from the breeder???

The person who owns the mare when she foals is the official breeder.

hi onalimb

Unless otherwise agreed to...the breeder of the foal is the owner(s) of the mare at the time of foaling.

There are circumstances (but apparently not in the case that you reference) when the mare owner(s) might not be the breeder of record...or alternatively might be only one of the breeders of record...although the mare owner(s) still own(s) 100% of the mare.

Two of the many possible examples might be...

...when a lease agreement specifically designates that the lessee of the mare will be the breeder of record of the foal...

...or in the case of a foal share (and depending upon the specific agreement reached between the mare owner(s) and the party(s) that is/are participating in the foal share), the breeder(s) of record could be other than the mare owner(s)...or alternatively could include (or be) the mare owner(s)...depending on the agreement.

I would guess that the overwhelming majority of foals are bred in the name(s) of the mare owner(s).

Respectfully

In the instance of Quarter Horses tho' the breeder use to be the owner of the mare at time of conception - it's been a few years since I dabbled with Quarters so I don't know if this still stands or not.
